Terms of Agreement Summary


WHEN WILL MY ORDER SHIP?

We do our best to meet the shipping times stated below. If we experience delays in production significantly beyond these estimates we will contact you with updates. Otherwise, your patience is much appreciated. We will ship the entire order together when all items are in stock and completed. Online orders placed Friday evening through Sunday night will be processed the following Monday. These estimates do not include transit time in shipping.

RETURNS

If you are not completely satisfied with our products, you may return them for a refund or exchange subject to the following terms and conditions:

  1. All returns must be accompanied by a valid Return Authorization Number (RA#). Call us at 253-845-0403 or email us at customerservice@warmoth.com to obtain an RA#. Please be ready to provide an order or invoice number.
  2. All RA#'s must be issued within ten (10) business days of receiving the product. If there is a problem with your order, please do not delay in contacting us.
  3. RA#'s must be written on the outside of the return packaging. Returns that do not clearly display an RA# on the outside of the packaging will be refused.
  4. All returned product must be in "as received" condition and unaltered in any way. Do not bolt together, install screws, sand, drill, rout, paint, file, take the protective plastic off pickguards or alter the product in any way until you have thoroughly inspected it for accuracy and have checked the fit. Product that has been altered in any way will not be accepted for return.
  5. Product must be packaged securely and with sufficient protection (as originally packed) to avoid damage in transit. If returned product shows evidence of damage from misuse, improper handling or insufficient packaging, it will not be eligible for refund or exchange.
  6. We do not accept returns on Books.
  7. We do not refund original shipping charges, return shipping charges or Customs Taxes, VAT or Duties.
  8. Refunds will be issued by the original method of payment. Credit Card refunds must be made to the exact credit card(s) used in the original sale.

WARRANTY

Warmoth Guitar Products, Inc. warrants its necks and bodies to be free from defects in materials and workmanship under normal use and service for the periods listed below:

2 Year Warranty coverage:

  • Necks hard finished by Warmoth
  • Roasted Maple necks
  • Exotic* wood necks
  • Guitar & Bass Bodies

1 Year Warranty coverage:

  • Necks that are hard finished competently by customers within 30 days of receiving product

* Exotic neck woods include, Ebony, Bocote, Bloodwood, Rosewood, Padouk, Wenge, Ziricote, Canary, Purpleheart, Bubinga, Goncalo Alves, Pau Ferro, and Imbuia.

The obligation of this warranty shall be limited to repairing or replacing any part which we agree is defective. Warmoth may not be held responsible for any return shipping costs to us. Though we will pay standard shipping costs from us to you. Under no circumstances will Warmoth be held responsible for Customs, Duties, VAT or any other taxes or fees. All returns must be accompanied by a copy of your receipt and return authorization number and must be shipped postage prepaid to:

This warranty is in lieu of all other express warranties, obligations or liabilities. ANY IMPLIED WARRANTIES, OBLIGATIONS OR LIABILITIES, INCLUDING BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY, SHALL BE LIMITED IN DURATION TO THE ONE YEAR OR THE TWO YEAR DURATION OF THIS WRITTEN LIMITED WARRANTY. ANY ACTION FOR BREACH OF ANY WARRANTY OF MERCHANTABILITY MUST BE BROUGHT WITHIN A PERIOD OF 12 MONTHS FROM THE DATE OF PURCHASE FOR THE ONE YEAR WARRANTY AND WITHIN A PERIOD OF 24 MONTHS FROM THE DATE OF PURCHASE FOR THE TWO YEAR WARRANTY. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. No agent, representative, dealer or employee of the Company has the authority to increase or alter the obligations of this warranty.

This warranty shall not apply to any product which is found to have been modified, repaired or altered in any way without express written consent from Warmoth. Warranty coverage is available to original purchasers only and is not transferable.

In no case shall Warmoth be liable for any consequential damages for breach of this or any other warranty, expressed or implied, whatsoever. Some states do not allow the exclusion of limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.

Bodies:

Our bodies are warranted to be free of defective materials and workmanship for a period of two years from the date of purchase. We craft our bodies from the finest materials and made to be compatible with Fender guitars. Warmoth Guitar Products, Inc. may not be held liable for any work done on merchandise later found to be defective, nor may modified parts be accepted for refund or exchange.

Please read through the following tips to help avoid any unnecessary heartache:

To ensure your complete satisfaction, we urge you to take time to check each feature of your new body to verify that it is suitable to your application. Until you are completely satisfied that this body will meet all your requirements, do not drill, rout, paint or modify it in any way.

Check the scale length. Place the neck in the body and position the bridge over its mounting holes. Measure from the nut to the 12th fret and double this length. The resulting figure should equal the length from the nut to the center of the bridge saddle throw. If there is a discrepancy here, call us now or consult your luthier.

Check the neck alignment. Will the strings be equally centered on the neck? This is done either with a string down the middle of the neck, or by using a straight edge down the sides of the neck. Because all necks don't have the same heel dimensions, some adjustments may be necessary.

When checking the fit between the body and the neck, please remember to allow for the thickness of the finish on both the body and the neck. Very tight fits are not necessary and will probably chip the finish. Be aware that the neck heels and the neck pockets are tapered. DO NOT slide the neck in from the end of the neck pocket. Instead, slide the neck in down from the top.

Check that the bridge holes in the body match the bridge you intend to use.

We'd like to offer a word of caution about wet sanding:

DON'T DO IT!

Only after there are several coats of hard finish on the body should you even consider wet sanding. Water will swell the wood and create all kinds of other problems. Be careful not to get water in the body holes and cavities. The end grain here is not well sealed and the glue lines will open very easily if they absorb water. We do not wet sand nor do we recommend this process

Necks:

Our necks are warranted to be free of defective materials and workmanship for up to two years from the date of purchase. Necks that require a hard finish, and that are finished by the purchaser will be covered for one year providing the application and type of finish used is deemed satisfactory by Warmoth Guitar Products, Inc. The warranty will be void if the neck does not get a hard shell finish in 30 days of delivery. We do not consider oil finishes or poorly applied wipe-on finishes adequate protection. Necks with shafts of Rosewood, Ebony, Pau Ferro, Bocote, Ziricote, Bubinga, Purpleheart, Padouk, Goncalo Alves, Satine, Roasted Maple or Wenge do not require a hard finish.

Warmoth Guitar Products, Inc. may not be held liable for any work done on merchandise later found to be defective, nor may modified parts be accepted for refund or exchange. Warmoth necks are carefully crafted from the finest materials. If treated properly, they should last for many years of playing enjoyment.

Please read through the following tips to help avoid any unnecessary heartache:

Before you drill, file, paint or otherwise modify your new Warmoth neck, please inspect it for any flaws or discrepancies. Be absolutely sure that your neck is correct for your application. Check it all out, before you proceed.

  1. Is the fret size as ordered?
  2. Is the nut width as ordered?
  3. Is the neck profile as ordered?
  4. Does the scale length match your old neck?

When checking the fit between the body and the neck, please remember to allow for the thickness of the finish on both the body and the neck. Very tight fits are not necessary and will probably chip the finish. Be aware that the neck heels and the neck pockets are tapered. DO NOT slide the neck in from the end of the neck pocket. Instead, slide the neck in down from the top.

For low action, new necks will usually require the fret leveling or dressing operation. This is not normally done until after finishing is completed. We suggest that this be done by a knowledgeable guitar tech/luthier.

Warmoth necks are intentionally milled with an under bow (string relief) which is apparent when the truss rod is slack. Tightening the truss rod will straighten the neck and can even pull it backwards if it is too tight. DO NOT leave the truss rod tensioned when the neck is unstrung as this may cause a permanently back bowed neck.

To adjust the truss rod, turn it clockwise to tighten or straighten, and counterclockwise to loosen or create more bow. If the adjustment seems overly hard, check the adjusting nut by removing and examining it for lubrication. Paraffin or grease should be apparent on the threads. If not, then lubricate the threads lightly.

Eyeballing the fret plane is a difficult, if not, impossible task. The compound radius fretboard creates an illusion of a twist. To be properly examined, a straight-edge is necessary. This is best left to knowledgeable guitar technicians.

CHANGES

If you need to make a change to your order, contact us as soon as possible by calling (253-845-0403) or replying to your order confirmation email and describing the requested change in detail.

Hardware, Pickups, Pickguards - We will gladly process deletions, additions, and changes to these items on open orders that have not shipped.

Necks & Bodies - Orders for Necks and Bodies begin production immediately upon order and are built to your custom specifications. Changes to Necks and Bodies are subject to the following conditions:

  • If the requested change can be achieved at the current stage of production on your Neck or Body, a $25.00 charge will apply
  • If the requested change requires us to restart production with a new Neck or Body, a 25% Restock charge will apply on the purchase price of the item

CANCELLATIONS

If you need to cancel all or part of your order, contact us by calling (253-845-0403) or replying to your order confirmation email with your cancellation request.

Hardware, Pickups, Pickguards – No cancellation charge will apply.

Necks & Bodies – Subject to a 25% Restock charge on the purchase price of the item.

Refunds will be issued by the original method of payment. Credit Card refunds must be made to the exact credit card(s) used in the original sale.

INTERNATIONAL SHIPPING

Warmoth is not responsible and will not pay duties, VAT or other import fees/taxes. You must be available to receive your shipment and be prepared to pay these fees.

TAXES

At this time, the only tax Warmoth must collect is the Washington State Sales Tax when we ship to an address in Washington State.

Warmoth Guitar Products, Inc. provides you services of Warmoth.com subject to the following conditions. If you visit or shop at Warmoth.com, you accept these conditions. Please read them carefully.

Electronic Communications

When you visit Warmoth.com or send emails to us, you are communicating with us electronically. You must agree to receive communications from us electronically. We will communicate with you primarily by email. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Registration; Customer Accounts; Use of Site

Certain services offered on or through the site require you to first open an account. You are responsible for maintaining the confidentiality of your account information on your computer, including your password, and for all activity that occurs under your account. You agree to notify Warmoth Guitar Products, Inc. immediately of any unauthorized use of your account or password, or any other breach of security. You may be held liable for losses incurred by Warmoth Guitar Products, Inc. or any other user of the site due to someone else using your password or customer account. You may not use a password or customer account that is not your own. You may not attempt to gain unauthorized access to the site. Should you attempt to do so, assist others in making such attempts, or distribute instructions, software or tools for that purpose, then your customer account will be terminated. You agree to provide us with accurate, current and complete information about yourself and your billing information as prompted by the registration process. You may update any of your account information, designate a different credit card to be billed, or change the applicable expiration date on your currently designated credit card, by clicking on the ‘My Account’ button and selecting the appropriate link. Conditions of Sale and Payment Terms

To purchase any goods and/or services on Warmoth.com, you must be at least eighteen (18) years of age or the applicable state age of majority. Prior to the purchase of any goods or services on our site, you must provide us with a valid credit card number and associated payment information including all of the following: (1) your name as it appears on the card, (2) your credit card number, (3) the credit card type, and (4) the date of expiration needed to charge your card. By submitting that information to us, you hereby agree that you authorize us and our credit card service provider to charge your card.

Methods of Payment, Credit Card Terms and Taxes

All payments on the Warmoth.com site must be made by VISA, MasterCard, American Express, or Discover credit cards. Your card issuer agreement governs your use of your designated card, and you must refer to that agreement to determine your rights and liabilities as a cardholder. You agree to pay all fees and charges incurred in connection with your purchases (including any applicable taxes).

Order Acceptance Policy

Your receipt of an electronic order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Warmoth Guitar Products, Inc. reserves the right at any time after receipt of your order to accept or decline your order for any reason. Warmoth Guitar Products, Inc. further reserves the right any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item. Your order will be deemed accepted by Warmoth Guitar Products, Inc. upon shipment of products or performance of services that you have ordered. Title to goods passes to you upon delivery to the common carrier. Should Warmoth Guitar Products, Inc. not fulfill your order completely after it is charged to your credit card, Warmoth will refund any outstanding amount. Orders over $2,000.00 (U.S.) value cannot be placed over Warmoth.com and must be phoned, faxed or emailed to the Warmoth Sales Staff. Warmoth may require additional verifications or information before accepting any order. After placing an order with Warmoth.com please monitor your email periodically in case we need to contact you for information.

No Responsibility To Sell Mispriced Products Or Services

Warmoth Guitar Products, Inc. shall have the right to refuse or cancel any orders placed for products and/or services listed at an incorrect price or containing any other incorrect information or typographical errors. Warmoth Guitar Products, Inc. shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, Warmoth Guitar Products, Inc. will issue a credit to your credit card account in the amount of the charge.

Modifications to Prices or Billing Terms

Warmoth Guitar Products, Inc. reserves the right, at any time, to change its prices and billing methods for products or services sold, effective immediately upon posting on the site or by email delivery to you.

Indemnification

You agree to indemnify and hold harmless Warmoth Guitar Products, Inc. and its owners, affiliates, officers, directors and employees from any claim or demand, including reasonable attorneys fees, made by any third party arising out of or related to your violation of this Conditions of Use, or your violation of any law, regulation or third-party right.

Limitation of liability

The entire risk arising out of the use of the site, the use of any products and/or services offered on or in connection with the site remains with you. In no event shall Warmoth Guitar Products, Inc. or any of their officers, directors, or employees be liable for any consequential, incidental, direct, indirect, special, punitive, or other damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, or other financial loss) arising out of these conditions of use or the use of or inability to use any products or services, with the delay or inability to use the Warmoth.com site or related services, the provision of or failure to provide products or services, or for any information, products, services and content obtained through the site, or otherwise arising out of the use of the Warmoth.com site whether based on contract, tort, negligence, strict liability or otherwise even if Warmoth Guitar Products, Inc. has been advised of the possibility of such damages. Notwithstanding anything else in this Conditions Of Use or posted on the site, the maximum liability that Warmoth Guitar Products, Inc. shall have is limited to any amounts actually paid to Warmoth Guitar Products, Inc. by the user. Order information such as billing or shipping address that is inaccurate or incomplete may result in delays that shall not be the responsibility of Warmoth Guitar Products, Inc.

Applicable Law; Jurisdiction

The Warmoth.com site is created and controlled by Warmoth Guitar Products, Inc. in the State of Washington, USA. The laws of Washington State will govern the Conditions of Use. Each of Warmoth Guitar Products, Inc. and User agree to submit to the jurisdiction of the courts located within Pierce County, Washington. The Conditions of Use, including all documents referenced herein, represents the entire understanding between User and Warmoth Guitar Products, Inc. regarding the relationship of the User with Warmoth Guitar Products, Inc. and supersedes any prior statements or representations. Headings used in the Conditions of Use are for reference only and shall not affect the meaning of any terms. By visiting any area on the Warmoth.com site or making a purchase via the Warmoth.com site, a User is deemed to have accepted the Conditions of Use.

Modification
